Welcome to GANLAND ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the GANLAND platform, including the ganland.io website, ganland.ai application, the GAN AI agent, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
1. Description of Services
GANLAND provides an AI-powered platform for generative art creation and NFT deployment on Superchain networks (including Base, Optimism, and other OP Stack chains). Our services include:
- GAN AI Agent: An artificial intelligence assistant that helps artists and musicians create generative art and deploy smart contracts
- Ganland Wallet System: A hierarchical deterministic (HD) wallet system for managing digital assets across multiple chains
- NFT Deployment: Tools for creating, minting, and managing NFT collections
- Ganland Explorer: A web application for browsing and interacting with Ganland collections
2. Beta Status & Disclaimer
PUBLIC BETA: The Ganland Wallet System and certain features are currently in public beta testing. By using these features, you acknowledge that:
- The software may contain bugs, errors, or vulnerabilities
- Features may change or be discontinued without notice
- You should not store significant value in beta wallet features
- We strongly recommend maintaining your own backup of any seed phrases or private keys
3. Wallet & Digital Assets
The Ganland Wallet System uses HD wallet technology to derive wallets for users. You acknowledge and agree that:
- You are solely responsible for maintaining the security of your wallet credentials
- We do not have custody of your private keys or seed phrases
- Lost credentials cannot be recovered by us
- All blockchain transactions are irreversible
- You are responsible for understanding the risks of cryptocurrency and NFTs
4. AI-Generated Content
Content generated through our GAN AI agent is provided "as-is." You acknowledge that:
- AI-generated art may not be completely original and could resemble existing works
- You are responsible for ensuring your use of generated content does not infringe on third-party rights
- We make no warranties regarding the originality or intellectual property status of generated content
- Commercial use of generated content is at your own risk
5. Superchain Operations
GANLAND operates primarily on Superchain networks (Base, Optimism, and related OP Stack chains). You understand that:
- Gas fees and network conditions vary by chain
- Cross-chain operations may involve additional risks
- Network upgrades or changes may affect service availability
- We are not responsible for network congestion, failures, or exploits
6. Prohibited Uses
You agree not to use our Services to:
- Create, mint, or distribute content that is illegal, harmful, or infringes on intellectual property
- Engage in money laundering, fraud, or other financial crimes
- Manipulate markets or engage in wash trading
- Attempt to exploit, hack, or attack our systems or other users
- Use automated systems to abuse our Services
- Impersonate others or misrepresent your identity
7. Intellectual Property
GANLAND, the GAN logo, and related marks are our trademarks. The GANLAND platform and its original content are protected by copyright and other intellectual property laws.
You retain ownership of content you create using our tools, subject to any third-party rights and the limitations described in Section 4.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GANLAND AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of digital assets, cryptocurrencies, or NFTs
- Loss of profits or revenue
- Smart contract failures or exploits
- Third-party service outages
- Errors in AI-generated content
9. Indemnification
You agree to indemnify and hold harmless GANLAND and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
10. Changes to Terms
We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
